Welcome to Modern Chic Home's website ("Site"). Please review the following terms of service that govern your use of the Site (the "Agreement"). We encourage you to review these terms and conditions whenever you purchase products from us or use our Site. Please be aware that your use of the Site constitutes your agreement to be bound of the following:
Payment Options
Orders may be placed online 24-hours a day. Payment is made through PayPal, which is safe and secure for customers. With PayPal you can either use your existing account or you can pay without being a PayPal member using your credit card (you are not required to sign up for a PayPal account to make a purchase). PayPal uses state of the art encryption safeguarding your financial and personal information and all information is automatically encrypted ensuring safe transactions. PayPal has quickly become the global leader in online payment solutions with over 100 million account members worldwide.
Here’s how PayPal works with our site: When you are ready to checkout with Modern Chic Home and place your order, you will hit the “confirm” button and will immediately be directed to PayPal where you can finalize your order and payment transaction with the credit card of your choice. If you do not wish to create a new account, simply click on the link that says, “Don’t have a PayPal account? Use your credit card or back account.” This is located near the bottom left side of the page, just above the various credit card icons. You’ll then click on Continue where it will prompt you to enter your credit card information. Modern Chic Home never sees or receives any of your personal credit card information. Experiencing issues when trying to process and pay for your order? Occasionally customers experience an error message from PayPal when trying to compete their transaction. The message(s) may say there was an error trying to process their transaction or that their credit card is not accepted and to use another form of payment. This seems to be an issue strictly with PayPal and we apologize for the inconvenience. If this happens to you and you are unable to complete your order, please call or email us right away. We’ll ask for your full name to look up your pending order in our system. From there, we will create a custom invoice through PayPal and email the invoice to you to pay in full. This method usually works without any issues and allows you to pay with a credit card or bank account.
Tax
We do not charge sales tax for any purchases, except those shipped to California. Purchases shipped to California residents will be charged 8.75% sales tax. Because we are located in California, we are required by law to charge sales tax in this state.
Shipping Information
We source all items for our online boutique with careful consideration and pride ourselves on offering resources that aren’t available just anywhere. Because we strive to keep the feel of our boutique exclusive, some items may take a little longer to ship compared to a number of businesses that excel at selling mass-produced products with speedy delivery times. Items in stock typically ship out within 3 - 5 business days. Transit time on standard shipping is 7-10 business days. Some items may be shipped directly from the manufacturer, and may take longer. Custom items, including furniture, typically have a lead time of 4 – 10 weeks.
Orders ship on business days Monday through Friday, excluding holidays. Please note that items ordered together may not be shipped out on the same day, and occasionally items may be temporarily out-of-stock or back ordered. We will email you with any updates regarding any out-of stock-delays or back ordered items in your order. If the out-of-stock delay is unsatisfactory, you may cancel your order and receive a refund upon request.
Shipping & Handling Charges
We offer FREE STANDARD SHIPPING on orders over $175 to the 48 contiguous states. Standard shipping is UPS Ground, USPS Priority Mail, or USPS Parcel Post, whichever is deemed most appropriate by Modern Chic Home. However, please note that certain furniture and other large items that are bulky and/ or heavy will have a delivery and processing surcharge. This charge will be included in the product price and will be stated in the product description. Please note that shipment to U.S. territories, AK, HI, islands within the continental U.S., P.O. boxes, APO/FPO addresses, are unavailable for oversized items.

For orders shipping to Alaska and Hawaii, shipping rates will be calculated based on live rates and product weight informationfrom the United States Postal Service or UPS. We will contact you with the total shipping rate once your order is placed. Payments for shipping charges will be payable via PayPal and must be paid in full before shipping your order.
We do not currently offer the option of expedited or express shipping. We also do not offer international shipping at this time. However, in the event you need an item expedited or if you are interested in having an item shipped internationally, please email service@modernchichome.com with your request and we will do our best to assist you.
Return Policy
We want you to buy with confidence from Modern Chic Home! If you are not completely satisfied with an item purchased, simply return it for an exchange or full refund within 30 days. You will be responsible for return shipping charges. Items must be unused and unassembled and in their original condition and packaging. Certain items will be subject to a 20% re-stocking fee such as wallpaper, custom pillows and other custom items. Custom upholstered furniture is non refundable, unless otherwise noted in the product description. Once an item is received, inspected and approved for return, your credit card will be credited the full amount, less shipping charges (including free shipping costs incurred by Modern Chic Home).
SUGARBOO DESIGNS PRODUCT SPECIFICATION & RETURN POLICY: All prints are custom made-to-order, therefore each sale is final; no refunds or exchanges on this item. All art manufactured by Sugarboo Designs is original and hand painted on wood. The pieces of wood used have character differences, including, but not limited to inclusions, grains, and knots. Therefore, natural variations do occur and should be expected. Sugarboo Designs ships items that conform to the samples shown at tradeshows and on www.sugarboodesigns.com. All images posted are photographed and supplied by Sugarboo Designs; depending on your computer screen, colors of each print may vary slightly in person.
In the event you refuse delivery and the package is returned to us, the order will be subject to the same return policy as outlined above, of which shipping charges will not be refunded and a 20% restocking fee will apply. If you refuse delivery on a custom order, no refund will be given. We are not able to accept returns on sale items.
In the event that damage occurs in transit, or if you discover any defect in manufacturing, please email service@modernchichome.com within 48 hours. We will gladly replace the item with no additional shipping fees. If you do not report a damaged item to us, you will be charged the cost of shipping the product back.

When registering as a member of Modern Chic Home, we will ask you to provide your name, email address and mailing address if you would like to receive our newsletter. We will use this information to notify you of site changes at Modern Chic Home and provide you with valuable offers from Modern Chic Home. All newsletters and promotional emails have an "opt-out" feature. When you order products, we will also need your billing and shipping information. This information should be as accurate as possible because we will use it for all contact, billing and shipping purposes respective to your enjoyment of Modern Chic Home.

While Modern Chic Home works diligently to review the safety of all products, Modern Chic Home cannot be held liable for accidents resulting in personal injury that involve a product purchased on the site.
This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. In addition, Modern Chic Home is not responsible for copyright, registration or licensing infringement of products sold on the site.

General
Modern Chic Home reserves the right to make changes to the terms of service of the Site at any time. Modern Chic Home may also, from time to time, change, move, delete portions of, or add to, the Site.
Other
This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions. This Agreement is governed by, and construed in accordance with, the laws of the State of California without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the state and/or federal courts of the State of California, County of Orange, and you further irrevocably waive any right you may have to trial by jury in any such dispute, action or proceeding.
